The Supreme Court on Wednesday came down hard on the Haryana Special Investigation Team (SIT) for allegedly going beyond its brief in the case against Ashoka University professor Ali Khan Mahmudabad.

The professor, who faces two FIRs over social media posts during Operation Sindoor, has been under investigation by the SIT. But a bench led by Justices Surya Kant and Dipankar Datta made it crystal clear: stick to the FIRs and finish the job in four weeks.

“Don’t try to expand the scope of the FIRs. SIT is free to form its opinion, but do not deviate from the task,” the bench warned sharply.

The top court also raised eyebrows over the SIT’s decision to seize Mahmudabad’s electronic devices, saying the agency seemed to have “misdirected itself” in the process. The court has now asked the SIT to submit a copy of its investigation report after presenting it to the jurisdictional court.

In a big relief for Mahmudabad, the Supreme Court eased one of his bail conditions — he can now write and share his opinions, but only if they don’t touch upon the issues under investigation in the FIRs. “He can write anything except on the specific matters mentioned in the FIRs,” said the bench.

This update follows a recent decision where the court extended his interim bail till the third week of July, but had continued the gag order on commentary related to the FIR issues.

At the May 29 hearing, senior lawyer Kapil Sibal, representing Mahmudabad, had pushed for that restriction to be removed. “He is an Oxford-educated mature person. He knows where he landed because of the writings. I am beseeching you to delete the condition,” Sibal argued. The court, however, wasn’t convinced at the time, saying it wanted to avoid any “parallel commentary” on the case.

Mahmudabad was arrested earlier this year for allegedly making objectionable social media posts linked to Operation Sindoor — leading to two FIRs being filed against him.

The Haryana SIT probing the matter includes top officers: ADGP Mamta Singh, SP Karnal Ganga Ram Punia, and SP STF (Gurgaon) Vikrant Bhushan.
